This offer is available only to “Eligible Claimants”, being individuals who live in Australia.
Subject to these conditions, an Eligible Claimant who, on or after 1/11/08, makes a Qualifying Purchase, is entitled to submit a one claim for a refund (a “Claim”). A "Qualifying Purchase" is a purchase of one Twinings Simply Tea 50 or 100 serve pack (each a “Twinings Simply Tea Product”) that is made at a retail outlet located in Australia at a reasonable price and on an arm's length basis.
To submit a Claim, an Eligible Claimant must: (i) enclose in an envelope, the original barcode from their purchased Twinings Simply Tea Product and a copy of that product’s purchase receipt; (ii) legibly write their own first and last names, postal address and telephone number on the back of the envelope; (iii) address the envelope to “Twinings Simply Tea TRY ME FREE Refund Offer”, REPLY PAID, Brookvale NSW 2100; and (iv) post the envelope to be received before 5pm (Sydney time) on 30th April 2009 (the “Claims Deadline”).
The purchase receipt copied and enclosed with an entry must be dated on or after 1/11/08 and must specifically identify a Twinings Simply Tea Product as a product purchased.
Maximum limit of one Claim per household. Each Claim requires a separate Qualifying Purchase. If more than one Claim is received in relation to the purchase of the same Twinings Simply Tea Product, only the first received Claim will be considered.
Each claimant must ensure that his/her Claim is received by the Promoter by the Claims Deadline. The Promoter takes no responsibility for lost, late, incomplete, incorrectly submitted or misdirected Claims, or for any delays or failures in the postal service. Claims that are received after the Claims Deadline will not be processed.
All received Claims become the property of the Promoter. By submitting a Claim the claimant is deemed to have accepted these conditions.
Claims will be processed in the order of receipt. Allow 28 days for the processing of a Claim from the date of its receipt.
The Promoter reserves the right, in its absolute discretion, to verify the validity of all Claims (including the right to confirm and verify the identity of a claimant, by requesting proof of identity and proof of residency. Identification considered suitable is at the Promoter's absolute discretion) and to not accept any, or all, Claims from a claimant who, in the Promoter’s opinion, has tampered with the Claim process or submitted a Claim that is not in accordance with these conditions.
A maximum of 5,000 Claims for Qualifying Purchases of 50 serve Twinings Simply Tea Products and 5,000 Claims for Qualifying Purchases of 100 serve Twinings Simply Tea Products will be accepted. When a Claim is accepted, a cheque will be drawn in favour of the claimant who submitted that accepted Claim (using the claimant’s first and last names as provided on the back of the envelope in which the Claim was received). That cheque will be posted to the claimant at the address provided on the back of the envelope in which the Claim was received. Subject to condition 11, the amount paid to the claimant by means of that cheque will be the amount paid by the claimant to purchase the Twinings Simply Tea Product that entitled him/her to make the Claim (as evidenced by the purchase receipt copied and enclosed with that Claim).
The provisions of this condition apply only to claimants if their address, as stated on their Claim, is in South Australia or ACT. The maximum amount that will be refunded to such claimants is:
a. $6.00 if the Twinings Simply Tea Product purchased is a 50 serve pack;
b. $9.00 if the Twinings Simply Tea Product purchased is a 100 serve pack.
The amounts stated in this condition have been determined on the understanding that Twinings Simply Tea Products cannot reasonably be offered for sale in arms length retail transactions in Australia at prices that exceed those amounts (the recommended retail prices of Twinings Simply Tea Products are $3.99 for a 50 serve pack and $5.99 for a 100 serve pack). If the maximum number of potential Claims were made and all those Claims were made by claimants from SA and ACT for the maximum amounts stated in condition 11 (which the Promoter considers to be highly unlikely), the total value of all refunds that will be paid is $75,000. This is the maximum, aggregate amount that will be paid in respect of all Claims.
The Promoter's decisions are final and no correspondence will be entered into.
To the full extent permitted by law, the Promoter, its associated companies and agencies and any of their personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) whatsoever which is suffered or incurred by any claimant connected with this offer, including: (i) any indirect, economic or consequential loss; and (ii) any loss arising from or contributed to by negligence of a Relevant Party.
Claimant details are collected only to enable offer administration. If a claimant fails to correctly provide those details, their claim may not be processed and they may not receive their refund. A claimant may contact the Promoter at the address below to request access to their details that are still held.
